Terms and Conditions

Welcome to Antony Ash (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website at https://antonyash.co.uk (“Site”) and any purchases you make of our products (“Goods”). Please read these Terms carefully before placing an order with us.


1. Definitions

1.1 “Buyer” means the individual or business who purchases Goods via the Site.
1.2 “Consumer” means a Buyer acting for purposes entirely or mainly outside their trade, business, craft or profession.
1.3 “Goods” means any products offered for sale on the Site.
1.4 “Contract” means the legally binding agreement between us and you for the sale of Goods, governed by these Terms.


2. Basis of Sale

2.1 All orders placed through the Site constitute an offer by you to purchase the Goods in accordance with these Terms.
2.2 We reserve the right to accept or decline your order for any reason (e.g., out of stock, suspected fraud). Acceptance is deemed to occur when we send you a confirmation e-mail that we have accepted your order (“Order Confirmation”). At that point, a Contract comes into force between you and us.


3. Goods & Availability

3.1 We endeavour to ensure all product images and descriptions are as accurate as possible. However:

  • Colour Variation Disclaimer: Colours of products as displayed on your device may vary from the actual Goods due to differences in screen resolutions, lighting, and device settings.
  • Natural Variation (Leather Products): We offer certain Goods made from genuine leather. Leather is a natural product; therefore, grain, texture, markings, and colour may vary from hide to hide. Minor discrepancies in hue, pattern or texture are not defects but inherent qualities of genuine leather.
    3.2 All Goods are subject to availability. If a selected item is unavailable after you place an order, we will notify you as soon as possible and offer either an alternative or a full refund.

4. Price and Payment

4.1 All prices on the Site are quoted in British Pounds Sterling (£) and include VAT at the applicable UK rate (currently 20%) unless otherwise stated.
4.2 We take reasonable care to ensure that the prices are correct. In the event of a pricing error after you place your order, we will notify you and give you the option to:

  • Confirm your order at the correct price;
  • Cancel your order for a full refund.
    4.3 Payment must be made in full at the time of ordering. We accept payment by major credit/debit cards and other payment methods clearly stated on the Site.
    4.4 You warrant that:
  • The credit/debit card or other payment method used is yours;
  • Payment details provided are correct and up to date;
  • Sufficient funds or credit is available to cover the cost of the Goods and delivery.

5. Delivery

5.1 We aim to dispatch in-stock items within 2 working days; if Goods are made to order or out of stock, we will provide an estimated delivery time when you place your order.
5.2 Delivery charges and estimated delivery times will be clearly stated at checkout.
5.3 Risk of loss and damage to Goods passes to you upon delivery. Title (ownership) of the Goods passes to you when you have paid in full.
5.4 If you fail to take delivery of the Goods when they are ready for delivery or we are unable to deliver due to an incorrect or incomplete address provided by you, we reserve the right to charge reasonable storage and/or re-delivery costs.


6. Consumer Cancellation Rights

(These rights apply only if you are a Consumer. If you purchase as a business, please refer to Section 7 below.)
6.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR 2013”), you have the right to cancel your Contract within 14 calendar days without giving any reason. The cancellation period ends 14 days after the day you receive the Goods.
6.2 To exercise your right to cancel, you must inform us in writing (e-mail is acceptable) before the 14-day period expires. You may use the Model Cancellation Form set out in Annex A (not mandatory).
6.3 You must send back the Goods promptly, and no later than 14 days from the day on which you communicate your cancellation. You bear the cost of return unless Goods are faulty or not as described.
6.4 We will refund you all payments received (including standard delivery charges) within 14 days of receiving the returned Goods (or evidence of their return). We may withhold the refund until we have received the returned Goods or evidence that they have been sent back.
6.5 Goods must be returned in substantially the same condition as delivered, unused, in original packaging (where reasonably possible), with labels and tags attached. We reserve the right to reduce a refund to reflect any diminished value of the Goods if they are not returned in satisfactory saleable condition.


7. Business Purchases & No Cancellation Rights

7.1 If you buy as a business, you acknowledge that you do not have a statutory right to cancel your order under the CCR 2013. All sales are final once you receive your Order Confirmation.
7.2 You may only return Goods if they are defective, damaged, or not as described, in which case Section 8.2 applies.


8. Faulty or Damaged Goods & Returns

8.1 If Goods arrive faulty, damaged, or materially not as described, you must notify us promptly (within 14 days of delivery). Please contact Customer Services via the “Contact Us” section of the Site or e-mail us at info@antonyash.co.uk
8.2 We will, at our discretion, offer a repair, replacement, or full refund (including original and return delivery costs).
8.3 Before returning any Goods, you must obtain a Returns Number (RMA) from us. We will provide instructions on how and where to send the returned Goods.
8.4 You must package the Goods securely and include a copy of your order confirmation or RMA. We strongly recommend obtaining proof of postage or using a tracked service.
8.5 We reserve the right to inspect the Goods upon their return. If we determine that the Goods are not faulty (e.g., the item was returned simply because you changed your mind without Consumer cancellation rights, or the damage was caused by you), we may refuse the refund or charge for any loss in value.


9. Product Descriptions & Intellectual Property

9.1 All product descriptions, illustrations, specifications, and data appearing on the Site are provided to the best of our knowledge but are subject to change without notice. Minor differences from those shown online do not constitute a breach of contract.
9.2 All intellectual property rights (including copyrights, trademarks, design rights and any other rights) in and to the Site and its content, and in any packaging, documentation and materials supplied in connection with the Goods, are owned by or licensed to us. You may not copy, reproduce, republish, upload, post, transmit or distribute any material from the Site without our express written permission.


10. Limitation of Liability

10.1 Subject to Section 10.3, to the fullest extent permitted by law, our liability to you for any loss or damage arising under or in connection with the Contract (including negligence) shall be limited to the purchase price of the Goods.
10.2 We shall not be liable for:

  • Any indirect, incidental, special or consequential losses (even if we were advised of the possibility of such losses);
  • Loss of profits, revenue, business or goodwill.
    10.3 Nothing in these Terms limits or excludes our liability for:
  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability which cannot be limited or excluded under applicable UK law.

11. Privacy & Data Protection

11.1 We process personal data in accordance with our Privacy Policy. By using the Site and placing an order, you acknowledge and agree to our collection, storage, and use of your personal information as described in the Privacy Policy.


12. Force Majeure

12.1 We will not be liable for any failure or delay in performing our obligations if such failure or delay is due to events beyond our reasonable control (e.g., acts of God, war, terrorism, strikes, fire, flood, government action, shortage of materials or utilities).


13. Governing Law & Jurisdiction

13.1 These Terms and any Contract formed under them shall be governed by and construed in accordance with the laws of England and Wales.
13.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.


14. Amendments to These Terms

14.1 We may revise these Terms at any time to reflect changes in the law or our business practices. The date of the latest revision will appear at the top of the page. Your continued use of the Site or placing an order after amendments indicates your acceptance of the revised Terms.


15. Severability

15.1 If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.
